PROPERTY VISUALS
Thank you for choosing Property Visuals for your listing media creation.
By booking Property Visuals, you agree to abide by the following Terms and Conditions:
1. Cancellation and Rescheduling:
We understand that unforeseen circumstances can arise, and we strive to be as accommodating as possible. The client may cancel or reschedule an appointment free of charge up to 2 hours before the scheduled time. However, if the client cancels or reschedules within 2 hours of the appointment, a $50 fee will apply.
In the event of bad weather, the client may reschedule free of charge up to 1 hour before the appointment. If the client chooses to cancel due to weather, the standard cancellation policy applies.
All late cancellations or rescheduling must be communicated by phone at (540) 588-8137.
2. Licensing:
Property Visuals grants the client a worldwide, limited, fully-paid license to use the listing media solely for the purpose of marketing the property for sale or rent. This includes use on MLS, Airbnb, VRBO, and in promotional materials such as flyers, brochures, and online listings. The client may also use the media for personal professional promotion (e.g., portfolio, website, or social media).
This license does not permit resale or gifting of the media and does not transfer ownership or intellectual property rights, all of which remain exclusively with Property Visuals.
If the client wishes to use the media for other purposes (e.g., company branding, unrelated advertising, or additional commercial use), additional licensing fees may apply. The client is responsible for obtaining any necessary permissions or releases for such use.
Unauthorized use of the media beyond the scope of this agreement may result in legal action.
3. Payment Terms and Late Fees:
Payment is generally due at the time of booking via our online order system and no later than delivery of the final media. Exceptions apply to clients with prepaid packages or those with a special payment arrangement.
We accept all major credit cards via our online booking system, as well as manual payments through Venmo, Apple Pay, Zelle, PayPal, check, or cash.
Other methods—such as cryptocurrency, foreign currencies, or alternative apps like Cash App—may be accepted upon request.
Late Fees and Collections:
Clients agree to pay all invoices by the due date stated. A 1.5% late fee per month may be applied to overdue balances. Invoices unpaid after 60 days may be turned over to collections or legal counsel, and the client will be responsible for any associated fees.
4. Refund Policy:
We have a no-refund policy on all orders. If the client is unsatisfied with the delivered media, we will make reasonable efforts to re-edit or reshoot when appropriate.
5. Use of Subcontractors:
Property Visuals may work with independent third-party contractors for certain services, such as photo/video editing, floor plan creation, or virtual staging/decluttering.
The client acknowledges that some deliverables may be completed by these contractors. While we strive to meet all deadlines, Property Visuals is not responsible for delays caused by third-party providers.
6. Delivery and Turnaround Times:
We aim to provide high-quality media in a timely manner. Our guaranteed turnaround times (from the time the shoot is completed) are:
Photographs: within 24 hours
Short-form video (e.g., reels): within 48 hours
Long-form/complex video (e.g., tours, agent-on-camera, special effects): within 72 hours
2D Floor Plans: within 24 hours
3D Floor Plans: within 72 hours
Marketing/Print Materials: within 3–5 business days
These timelines are guaranteed only if third-party contractors deliver their work on time.
While not guaranteed, our typical delivery times are faster—photos and floor plans are often delivered the next morning, and videos within 48 hours.
Please note: Some projects may require additional time to ensure quality. No discounts are offered for extended delivery timelines due to extra editing or complexity.
7. Accuracy:
We aim to capture the property as accurately as possible. However, we are not responsible for:
Minor color discrepancies between real-life and final images
Floor plan dimensions differing from public records or tax rolls
8. Property Preparation:
It is the client’s responsibility (or that of the homeowner/tenant/agent) to ensure the property is fully prepared prior to our arrival. This includes cleaning, decluttering, and staging indoor and outdoor areas.
Due to insurance and liability restrictions, Property Visuals cannot:
Move large items
Clean or repair spaces
Perform tasks requiring a contractor’s license
We offer a free branded Property Prep Guide upon request to assist with preparation.
If the property is not ready, we will do our best to create the media as-is. We will attempt to contact the agent to ask whether to proceed or reschedule. Due to a tight schedule, we cannot wait more than 30 minutes on-site. In such cases, a reshoot or rescheduling will be required, and rescheduling or cancellation fees may apply.
9. Limitation of Liability:
Property Visuals is not liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profit, revenue, data, or goodwill—arising from use of, or inability to use, our services.
10. Liability:
The client agrees that Property Visuals, its employees, and independent contractors are not liable for any claims, damages, losses, or injuries resulting from our services or activities on-site.
Use of our services is at the client’s own risk. The client agrees to indemnify and hold harmless Property Visuals, its employees, and contractors from any related claims or expenses.
11. Changes to These Terms and Conditions:
We may update these Terms and Conditions as needed. Any updates will be posted on this page with a revised “Last updated” date. We encourage clients to review this page regularly.
